Cassidy Pictures provides a platform for users to rent or purchase and stream films from Cassidy Pictures (the "Service").
2. Acceptance of Terms
By using our Service, you agree to comply with these ToS and our Privacy Policy. If you are using the Service on behalf of an organization, you are agreeing to these ToS for that organization and promising that you have the authority to bind that organization to these terms.
3. User Conduct
You agree not to use the Service for any illegal or unauthorized purpose. You agree to comply with all laws, rules, and regulations applicable to your use of the Service. You must not:
- Interfere with or disrupt the Service or servers or networks connected to the Service.
- Attempt to gain unauthorized access to the Service, user accounts, or computer systems or networks connected to the Service.
- Share your account credentials or otherwise authorize a third party to access or use the Service on your behalf.
4. Intellectual Property Rights
All intellectual property rights in and to the Service, including the film, website design, text, graphics, and other content, are owned by Cassidy Pictures. You are granted a limited, non-exclusive, non-transferable license to access and view the film for your personal, non-commercial use only. You may not download, copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any content for any other purposes without the prior written consent of Cassidy Pictures.
5. Account Registration
To access the Service, you must create an account. You are responsible for maintaining the confidentiality of your account and are fully responsible for all activities that occur under your account. You must be at least 13 years of age to create an account.
6. Payments
All payments for renting or purchasing the film are processed through our third-party payment processor, Stripe. By providing a payment method, you represent and warrant that you are authorized to use the designated payment method.
7. Termination of Service
We may suspend or terminate your access to the Service at any time, without notice, for any reason, including for a violation of these ToS.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Cassidy Pictures shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the service; (b) any unauthorized access to or use of our servers and/or any and all personal information stored therein.
9. Indemnification
You agree to defend, indemnify, and hold harmless Cassidy Pictures and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not to limited attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.
10. Modifications to the Terms
We reserve the right to modify these ToS at any time. We will notify you of any changes by posting the new ToS on this page. You are advised to review these ToS periodically for any changes.
11. Governing Law
These ToS shall be governed and construed in accordance with the laws of the State of Maine, United States, without regard to its conflict of law provisions.
